Purchase rules

Payment

All product prices are indicated in Euros including VAT.

The payment is considered made from the moment the funds are actually credited to the seller's bank account. The purchase document (invoice) is sent to the buyer by email.

The buyer has several options for paying for the goods.

·         Payment for goods via Paysera online. Paysera is a safe, easy and cheap way to make payments and send and receive money online. The Paysera system includes all traditional payment methods.

·         Pay via Paypal online.

·         Purchase by installments with Inbank. You can buy the desired product for up to 10,000 euros in a particularly convenient and fast way by making an installment purchase. All you have to do is select the products you want and we will offer you the best financing offer. We provide the service together with our partner Inbank. We finance the price of a product from 100 to 10,000 euros; You can choose a repayment period of up to 60 months; The contract can be concluded by persons at least 18 years of age; By purchasing goods in installments, you immediately become the owner of the goods; You can choose whether you want to make a down payment or start paying only next month; The amount due will be distributed monthly in accordance with the established schedule. The hire purchase service can be used by persons: receiving wages under an employment contract; receiving regular benefits from the Sodra Foundation (pensions, benefits, etc.); pensioners of ministries (receiving pensions paid by ministries); Farmers, individual entrepreneurs; Working abroad (receiving income to an account in a Lithuanian bank). To use the installment payment service, you need to have one of the identity documents: a passport of a citizen of the Republic of Lithuania or an identity card; Permanent residence permit in the Republic of Lithuania.

After properly filling in the payment fields and having paid for the goods in full, the buyer will receive an order confirmation by e-mail. 

Delivery

Delivery of orders over 50 euros is free of charge.

Orders under € 50 are delivered at the rates indicated below.

The goods can be delivered through postal terminals or by courier to the address you specified.

In Lithuania the goods are delivered by the LP Express parcel delivery service (the cost of delivery through the postal terminal is 3 euros, the cost of delivery by courier is 4 euros).

In Estonia the goods are delivered by the OMNIVA parcel delivery service (prices are calculated when paying for the order).

The delivery time can be seen after choosing a product in the "Delivery" section. The preliminary date is indicated here. The buyer agrees that the seller is released from liability for delayed delivery of the goods due to unforeseen circumstances and / or circumstances beyond the control of the seller.

If several goods are ordered at the same time, the Seller reserves the right to deliver the goods in separate parts.

If in the "Delivery" section you see different delivery times when ordering several items at the same time, the maximum specified delivery time will be considered the total delivery time.

If, when ordering several goods at the same time, in the "Stores" section you see that the goods are sent from two countries (Lithuania and Estonia), only courier delivery or receipt of goods in the selected store is valid for the delivery.

The buyer undertakes to correctly indicate the exact place of delivery of the goods.

When delivering goods by courier, the buyer must check the condition of the parcel and the goods in the presence of the courier. After the transfer of the goods to the buyer, it is considered that the package has been handed over in good condition and the goods have no damage that can be determined by external examination of the goods. If it is noticed that the package of the parcel is damaged( i.e. wrinkled, wet or otherwise damaged on the outside) or the goods are delivered incorrectly, the buyer must draw up in any form a statement of damage or inconsistency of the parcel with the signature of the courier. The buyer's failure to comply with this condition releases the seller from liability, in which case it is considered that the goods were delivered in good condition and of good quality.

 

Free receipt of goods in the store.

1. If you have selected the goods that are in the store you have chosen, the goods will be ready within 2 working hours from the moment of placing the order (this condition is valid if order is completed on working days). We will inform you about this by e-mail and / or SMS.

2. If you have chosen to receive the goods in the store, and these goods need to be delivered to the store of your choice from the warehouse, in this case we will deliver them to the store of your choice within 1-3 business days after placing the order. We will inform you about this by e-mail and / or SMS.

When picking up a paid order, have the order number and an identity document with you. If your goods will not be picked up by you, indicate the recipient when placing the order. And if the buyer is a legal entity, have a power of attorney.

 

IMPORTANT: If your order has to be shipped outside the EU in order to receive the order, you may have to pay VAT, customs duties, etc. Tax policies vary from country to country, so we cannot predict how much it will cost. We recommend that you contact your local authorities for running costs prior to placing an order to avoid unexpected waste. Please note that if you are requesting the return of an item for which you paid duty, the duty will not be refunded as these are additional costs to the buyer.


Delivery to Russia and Belarus is not available.

Warranty

In order to avoid misunderstanding, you must carefully read the information about how to use the item.

•    The delivered goods may be slightly different from the displayed on the Internet; therefore, the customer must carefully read the information on the item in advance, before confirming the order. In the meanwhile, every effort is made in order to ensure that the photographs at the online shop tomasgold.lt depicting the colours, models and styles of the products correspond to the original products; however, there may be some differences due to technical limitations trying to recover the colour on the screens of your computers or phones. Accordingly, tomasgold.lt shall not be liable in any circumstances for any errors or inaccuracy of the photographs or graphic images of products posted on the website. Weight of the same models can be slightly different.  

•    Parameters of the mounted precious stones indicated on the website (the colour or clearness of a brilliant) in certain cases may be different from the parameters established for the precious stones or products by the Lithuanian Assay Office, since when assessing the mounted products the Lithuanian Assay Office provides a 20% error probability for their evaluation.

•    Warranty is provided only to the goods with the manufacturer’s defect, and is not provided to the goods otherwise damaged by accident, improper use, mistreatment, negligence or depreciation.

•    Warranty shall not be applicable in case the item was partially altered by third parties engraving it, adjusting the size of it or otherwise changing the item.

•    In case any part of the jewellery (including stones, necklace, and clasp) falls off, it shall be returned together with the other parts before intending to carry out any fixing.
Tomas Gold does not take any responsibility for the lost elements or stones. 


Please note that the product warranty does not apply if the product has been repaired by another jeweler.

Return

EXCHANGE / RETURN OF GOODS PURCHASED IN ONLINE STORE

By purchasing goods in the online store https://tomasgold.lt/ you have the right to terminate the distance contract within 14 calendar days from the date of receipt of the goods, notifying us about this by e-mail [email protected]

If the purchased product was delivered to you of inadequate quality, immediately, but no later than within 14 calendar days from the date of delivery of the product, contact us by e-mail [email protected].

* A gift certificate purchased online cannot be returned or exchanged (neither for another electronic gift certificate, nor for cash).

* Gift boxes purchased online cannot be returned or exchanged.


According to 7 clause of Art. 6.363 of the Civil Code of the Republic of Lithuania, the Buyer, having bought goods of inadequate quality, has the right to demand from the Seller:

1.       eliminate product defects (repair);

2.       replace a low-quality product with a quality one;

3.       to reduce the price accordingly;

4.       terminate the contract and return the price paid.

 

 According to 3 clause of Art. 6.363 of the  Civil Code of the Republic of Lithuania, a product is considered to be of high quality if:

·         Complies with the description and characteristics specified in the online store;

·         Suitable for general use just like other products of the same type;

·          The quality and characteristics of the product are what you would expect from another product of the same type.

 

EXCHANGE / RETURNS IMPLEMENTES ON THE FOLLOWING TERMS:

1. Labels and certificates have not been removed from the goods and have preserved their integrity, i.e. not cut or otherwise damaged;

2. a document (invoice) has been presented confirming the purchase of the goods;

3. product packaging (protective film) is not damaged;

4. the goods have not been used / worn, not damaged by the Buyer deliberately or through negligence, the presentation of the goods is completely preserved;

5. The returned goods must be in the same configuration as received by the Buyer;

6. exchange for another product of the same value is possible only once;

7. Goods with precious stones (for example, diamond, sapphire, ruby, emerald, topaz, smoky quartz, amethyst, garnet, etc.) must be checked by the Assay Office of the Republic of Lithuania before exchange / return. The Assay Office of the Republic of Lithuania must confirm that the returned goods are of proper quality, have no damage, and the precious stones correspond to the data of the primary examination (primary certificate);

8. goods made to order or adapted for individual use (corrected size, engraving, etc.) cannot be replaced or returned in accordance with the laws of the Republic of Lithuania.

9. Goods that have been repaired or their original design changed by the Buyer himself or another jeweler who is not Uab Tomas Gold jeweler are not exchangeable or refundable.

10. Investment GOLD/SILVER/PLATINUM/PALLADIUM products (bars, coins), in accordance with the laws of the Republic of Lithuania and the European Union, after an order has been placed and the price has been fixed, are non-returnable goods. If you wish to cancel the order, we can only accept it back according to the specified product buyback prices.

 

The Buyer is responsible for the loss of the product's market value as a result of actions that were not necessary to determine the properties of the product.

 

The Buyer can return the goods purchased in the online store by sending the return by registered mail or using the courier service at:

The sent parcel must be reported to the Seller by e-mail [email protected].

The Buyer assumes responsibility for the safe packaging of the parcel so that the contents of the parcel are not damaged / lost during delivery to our doors.

The Buyer pays all costs for the exchange / return (delivery, examination of the goods in the assay office of the Republic of Lithuania).

 

Having received the goods, the Seller evaluates it, and only after that informs the Buyer about the final decision whether the goods meet the requirements for replacement / return. If the conditions of the returned goods are not met, the money is not returned, the goods are sent back to the buyer.

After confirming the refund, the money for the returned product will be transferred to the bank account from which the purchase was made within 10 working days from the date of receipt of the goods by the Seller.

If the Buyer paid for the goods in the online store with an electronic gift certificate, the gift certificate is returned to Buyer by e-mail, and the additional amount paid (if any) is returned by transfer to the buyer's bank account within 10 working days.

 

After the expiration of the period (14 calendar days), during which, according to article 6.22810 of the Civil Code of the Republic of Lithuania, the buyer can exercise the right to terminate the distance contract, within 6 months of the warranty period, the Seller has the right not to accept the goods returned by the Buyer if:

·         Missing product label, gem certificate;

·         There is no document confirming the purchase of goods (invoice);

·          The goods are damaged by the Buyer deliberately or through negligence;

·         The product has mechanical damage;

·         Incomplete set of goods, the set does not correspond to the original one received by the Buyer (lost parts of precious metal, precious stones);

·         Product defects caused by improper use or care;

·         Failure to comply with the rules for the safe use of jewelry (for example, the product was exposed to high temperatures or chemicals);

·         The product is made to order or adapted for individual use (size / length was adjusted, engraved, etc.);

·         Traces of technical repairs carried out by the Buyer or a third party are visible;

·         Visible natural wear and tear;

·         More than 6 months have passed since the purchase.

IMPORTANT: a product with precious stones (for example, diamond, sapphire, ruby, emerald, topaz, smoky quartz, amethyst, garnet, etc.) must be checked and sealed by the Assay Office of the Republic of Lithuania before exchange / return. The Assay Office of the Republic of Lithuania must confirm that the returned goods are of proper quality, have no damage, and the precious stones correspond to the data of the primary examination (primary certificate)!
